Rules of Video Contest!

hese are the rules of the Contest: * All films must be no more than :30 seconds in length. * All participants must agree to and sign an Indemnity form. * All films must be viewable by a public audience. * Any filmmaker partaking in unlawful or anti-social behavior (including 'jackass' style filmmaking) will be disqualified. * The filmmaker must have the permission of all actors/extras featuring in any film. * By entering a film in Sassy Contest you are giving permission for your work to feature in any way, shape or form, as part of any Sassy related event. * Films are permitted to use superimposed text. Official Rules NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. 1. Agreement to Official Rules: By participating in the Contest, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Judge Panel, which are final and binding in all matters related to the Contest. Whether an entrant receives a prize is contingent upon fulfilling all requirements set forth herein. 2. Timing: The submission period ends on October 1, 2009 at 11:59 p.m. ET (the "Submission Period"). 3. How to Enter: Simply register your name, e-mail address, and link to video. During the Submission Period, entrants must visit www.sassyshampoo.com (the "Website") and follow the links and onscreen instructions to register. By completing the registration and submitting your Entry, you agree that your Entry conforms to the Terms and Conditions as defined below (collectively, the "Guidelines and Restrictions") and that Sassy, in its sole discretion, may remove your film and disqualify you from the Contest if it believes, in its sole discretion, that your film fails to conform to the Guidelines and Restrictions. Content Restrictions: The Entry must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement; Entrant has all rights necessary to submit the Entry in the Contest in accordance with these Official Rules; The Entry must not contain material that is inappropriate, indecent, obscene hateful, tortuous, defamatory, slanderous or libelous; The Entry must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and The Entry must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where film is created. For all Entries: All Entries will become the exclusive property of Sassy, and none will be acknowledged or returned. Sassy shall have the right to edit, adapt and publish any or all of the films, and may use them in any media without attribution or compensation to the entrant, his/her successors or assigns, or any other entity. SUBMITTING AN ENTRY IN THIS COMPEITION CONSTITUTES ENTRANT'S IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANFERENCE TO SASSY OF ANY AND ALL RIGHT, TITLE AND INTEREST IN THE FILM INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS. Sassy is not responsible for lost, late, incomplete, invalid, un-intelligible or misdirected films, which are disqualified. 4. Winner Determination: The winner will be determined through 2 rounds of judging. First, a group of qualified judges determined by the “Sassy Girls” in its sole discretion will select the top Entries from all eligible Entries received during the Contest Period ("Finalists") based on the following criteria: Creativity, Originality, appropriate use of Sassy Products ("Judging Criteria"). In the case of a tie, the entrant whose Entry received the highest score in the Creativity category will be deemed a Finalist. Second, the results of public ranking and number of website hits. All decisions of the judges are final on all aspects of the Contest. 5. Winner Requirements: Potential winners must comply with all terms and conditions of these Official Rules; and winning is contingent upon fulfilling all requirements. The potential Contest winner (parent/legal guardian if winner is a minor in his/her state of residence) may be required to execute and return to Administrator, within 10 days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release ("Affidavit") in order to claim his/her prize. If the potential winner cannot be contacted, fails to execute and return the Affidavit within the required time period, or notice is returned as undeliverable, potential winner forfeits the prize. In the event that the potential winner of round 2 is disqualified for any reason, the qualified judges will select an alternate winner from amongst the Finalists based on an application of the Judging Criteria by law. 6. Prize: 1 GRAND PRIZE: The winner of the Contest will win a Grand Prize of an iPod Touch in addition to the Contest winner’s commercial being premiered on the Sassy Shampoo homepage and other related marketing materials. 7. General Conditions: Sassy reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sassy's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sassy in its sole discretion. Sassy, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or those of any other Contest or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sassy reserves the right to seek damages from any such person to the fullest extent permitted by law. Sassy's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 8. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest, including the production and submission of the entry film(s), or receipt or use or misuse of any prize. Sassy is not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sassy and Administrator are not responsible for any typographical/other error in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Contest. 9. Disputes: All disputes arising in connection herewith shall be interpreted under the laws of the State of Connecticut and referred exclusively to arbitration in the New Haven County before a single arbitrator familiar with entertainment law approved by the Independent Film and Television Alliance (IFTA, ex-AFMA); the arbitral award shall include reasonable attorneys fees and costs, and may be enforced in any court having jurisdiction thereof.
